Doctor fined after disastrous breast reduction PDF Print E-mail

The Supreme Court in The Bahamas has awarded a local woman damages of more than $200,000 for the pain and suffering she endured following a breast reduction procedure performed there nine years ago.
The court was told by the claimant that Dr. Philip Thompson and Dr. Leighton Logan were negligent in their performance of breast reduction surgery on her, and were also negligent in their post-operative care. The actual trial took place three years ago, but the final judgement was not made until yesterday.

The court did not accept the claimant's charge that there was any negligence by the doctors in the performance of the operation, but did find that the woman, now in her early 40's, did not receive the care and attention in her post-operative treatment from Dr. Thompson, that she could reasonably have expected.

"The court further found that Dr. Thompson failed to discharge his duty of care to the plaintiff in the post-operative phase," the ruling says.

"In addition, the court found that Dr. Thompson failed in his duty of care to the plaintiff in not attempting to remove the cause of the infection by performing surgery on the infected and devitalized tissues."

The woman had claimed that Dr. Thompson's promise to her that she would be able to enter a wet t-shirt competition was a guarantee by him of a successful outcome of the surgery. The court disagreed and did not find in her favour on this point.

Before the surgery, the woman had normal breasts, although she felt that they were too large and were causing her back pain. The breast reduction surgery had left her with severely scarred breasts, noticeably different in size. The left breast is now approximately twice the size of the right one and she has multiple scars across and beneath both breasts. In addition, she has lost a portion of her right areola and her right nipple.

"The ineffaceable scars must be an ever present reminder of the derogation of her womanhood," Justice Wallace said.

"The plaintiff has suffered much," he wrote. "She has had to endure five surgeries. Her scars will be with her forever."
