Liposuction Surgeon Loses Battle in Court PDF Print E-mail

A panel of three judges has decided that Ontario's medical regulator was correct in demanding cosmetic surgeon Dr. Behnaz Yazdanfar to stop performing surgical operations on patients.

The divisional court ruling declines Dr. Yazdanfar's attempt to go back to business after the College of Physicians and Surgeons handed out last month an uncommon order against her constraining her from conducting "all surgery," which includes breast enhancements and liposuction surgeries.

Justices Janet Wilson, Sidney Lederman and Katherine Swinton established that the college behaved fairly according to the evidence demonstrating that

the conduct of (Yazdanfar) exposes or is likely to expose her patients to harm or injury.

Dr. Yazdanfar, 39 years of age, who since 2000 has focused in cosmetic surgical procedures, may now only support other doctors in a hospital setting and cannot give preoperative or postoperative care until the result of a disciplinary hearing. Set to start next month, the hearing will focus on college accusations of professional misconduct and incompetence concerning 28 patients between 2005 and 2007.

A ruling is not likely to be made until the end of the year. Dr. Yazdanfar's lawyer, Tracey Tremayne-Lloyd stated that her client is "very upset" by the ruling. She said,

It is a denial of natural justice, there's no question.

The demand of the college against Dr. Yazdanfar originates from its inquiry into the death of the real-estate agent Krista Stryland in 2007 after a liposuction procedure at the doctor’s cosmetic facility.
